Terms & Conditions

Last updated: October 3, 2026

These terms govern the use of EMCO Booth's photo booth rental services and website (emcobooth.com). By booking our services or using our website, you agree to these terms.

  1. Booking and confirmation

A booking is confirmed only after the deposit is paid and the Service Agreement is signed. The deposit is 35% of the booking total before tax and is non-refundable. The balance plus tax is due 7 days before the event for delivery bookings, or at pick up for pick up bookings. Card payments include a 5% processing fee.

Date changes are subject to availability and must be requested at least 14 days before the original event date.

  2. Cancellations

Cancellations must be made in writing. No refunds are issued; store credit may be granted based on timing, as set out in the Service Agreement. If EMCO Booth cannot fulfil a booking for reasons within our control, all payments are refunded.

  3. Client responsibilities

The client must provide accurate event details, adequate space and power at the venue, and a safe environment for our team and equipment. Damage to or loss of equipment caused by the client, guests or third parties is the client's financial responsibility. For pick up bookings, the equipment is in the client's care from pick up until it is returned.

  4. Photo and video usage

By booking, the client allows EMCO Booth to use event photos and videos for marketing (website, social media and promotional material) unless a written opt-out is provided before the event. All photos and videos remain the property of EMCO Booth unless agreed otherwise in writing. Clients receive a non-exclusive license for personal use.

  5. Liability

EMCO Booth is not liable for indirect, incidental or consequential loss arising from our services. Our maximum liability for any claim is the amount paid for that booking. We are not responsible for delays or failures caused by circumstances beyond our reasonable control.

  6. Service delivery

We make every effort to deliver services as agreed and use backup solutions when equipment fails. Delays on the client's side that reduce setup time are not compensated by extended operation.

  7. Service Agreement

Every booking is also governed by the EMCO Booth Service Agreement signed at checkout. If these terms and the signed agreement differ, the signed agreement applies.

  8. Governing law

These terms are governed by the laws of the United States and the state in which EMCO Booth is registered.
